1. Acceptance of Terms

By installing Magic Wishlist from the Shopify App Store, you ("Merchant" or "you") agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not install or use the app.

2. Description of Service

Magic Wishlist is a Shopify application that enables shoppers to save products they love and helps merchants recover lost sales. The service includes:

• Guest and logged-in wishlists with variant-level saving
• Automated recovery emails: abandonment reminders, price drop alerts, low stock warnings, and back in stock alerts
• Auto-generated personal discount codes for use inside recovery emails
• Wishlist sharing via link, email, WhatsApp, Facebook, and Twitter
• Branding customization, multi-language support, and analytics
• Native integrations with Klaviyo, Omnisend, Mailchimp, Yotpo, Meta Ads, Google Analytics 4, Shopify Flow, n8n, and Make

3. Account & Eligibility

To use Magic Wishlist, you must:

• Have an active Shopify store in good standing
• Be at least 18 years of age (or the age of legal majority in your jurisdiction)
• Have the authority to bind your business to these Terms
• Comply with Shopify's Terms of Service and merchant policies

4. Pricing

Magic Wishlist is free to install and use, forever. Every feature is included at no cost. There are no hidden fees, no usage charges, and no credit card is required.

If we ever introduce optional paid features in the future, the features available at the time you installed will remain free for your store, and any new paid features will be clearly opt-in.

5. Acceptable Use

You agree not to use Magic Wishlist to:

• Violate any applicable laws, regulations, or third-party rights
• Send unsolicited bulk email or any communication that violates anti-spam laws (CAN-SPAM, CASL, GDPR, etc.), and only the recovery emails configured for legitimate wishlist activity are permitted
• Attempt to reverse engineer, decompile, or disassemble the app
• Circumvent or disable any security or rate-limit features
• Resell, sublicense, or redistribute the app or any of its components
• Interfere with or disrupt the integrity or performance of the service

6. Data & Privacy

Your use of Magic Wishlist is subject to our Privacy Policy. You retain ownership of your store data and your shoppers' data. We process that data solely to provide the Magic Wishlist service on your behalf.

7. Intellectual Property

Magic Wishlist (including the source code, design, branding, trademarks, and documentation) is owned by Magic Apps, LLC. We grant you a limited, non-exclusive, non-transferable, revocable licence to use Magic Wishlist on the Shopify stores you control, for as long as the app is installed.

8. Disclaimer of Warranties

Magic Wishlist is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee uninterrupted service, the recovery of every lost sale, or the deliverability of every email. Email delivery depends on factors outside our control including your store's domain reputation, recipient mail providers, and shopper inbox behaviour.

9. Limitation of Liability

To the maximum extent permitted by law, Magic Apps, LLC shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost data, or business interruption, arising out of or related to your use of Magic Wishlist. Because the service is provided free of charge, our total aggregate liability to you shall not exceed one hundred United States dollars (USD $100).

10. Indemnification

You agree to indemnify, defend, and hold harmless Magic Apps, LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of Magic Wishlist, your violation of these Terms, or your violation of any third-party right including any anti-spam, privacy, or intellectual-property right.

11. Termination

You may terminate your use of Magic Wishlist at any time by uninstalling the app from your Shopify Admin. We may suspend or terminate your access if you breach these Terms or if required to do so by Shopify or applicable law. Following uninstallation, we delete your store data within 30 days as required by Shopify's app policies.

12. Governing Law

These Terms are governed by the laws of the jurisdiction in which Magic Apps, LLC is registered, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms shall be resolved exclusively in the courts of that jurisdiction.

13. Changes to These Terms

We may modify these Terms from time to time. When we make material changes, we will notify you via email or through a notice in the app dashboard before the change takes effect. Your continued use of Magic Wishlist after the effective date constitutes acceptance of the revised Terms.
